Terms of Use for Customers
- General
1.1 Gimel Technologies GmbH (“Gimel”) operates a digital identity and trust platform for the storage of personal data (“Gimel Platform”). The Gimel Platform allows users to store your personal data in a Gimel Account and to use various Gimel services* (“Services*”), in particular the transfer of all or part of their data to or from our partners (“Gimel Partners”). By storing your personal data in your account (“Gimel Account”), you create your personal digital identity (“Gimel ID”) and establish your personal wallet (“Gimel Wallet*”). This Wallet can also be customized for organization (“Bespoke G-Wallet”). The Gimel ID is being owned and governed by the Gimel Foundation, which is supported by Gimel as IT, trust service and wallet provider.
1.2 In order to update your identity and secure it with the security protocol of the Gimel Platform, you are requested to a) verify the Gimel ID with the digital identity from your national ID card (e.g. in Germany, eID for the “Personalausweis”) and upgrade the Gimel ID through one of the structure partners, i.e. DNA sequencing labs or corresponding hospitals. Unverified identities are not ready for use after a grace period. Unverified and non-upgraded identities are not supported with the full security protocol of the Gimel Platform, e.g. not continuously being assessed as risks (“DefconG”).
1.3 The Gimel Platform and related services are intended for use by natural persons over the age of 18 years. The use of the Gimel Platform and its services is generally free of charge for end users. Please note that certain services may be subject to charges, which will be indicated separately in advance. You are responsible for any connection or transmission charges incurred because of your use of the Gimel Platform and Services*. These Terms of Use exclusively govern the relationship between you as an end user and Gimel with respect to the use of the Gimel Platform and Services*, including the creation and use of the Gimel ID. Any dealings between you and the Gimel Partners or other third parties are governed exclusively by the terms and conditions agreed between you and the relevant Gimel Partners or other third parties.
1.4 In accordance with these Terms of Use, the term “Data” refers to all personal data stored in your Gimel Account. For the purposes of these Terms of Use, personal data is defined as any information relating to an identified or identifiable natural person. This includes the following information: This includes your surname, first name and any pseudonyms you may have chosen, as well as your e-mail address, telephone and mobile phone numbers, home address, identity card and passport details, driving license details, bank account details and other payment details. Personal data will only be collected, processed and exchanged between Gimel and its partners in accordance with the applicable legal provisions. - Subscription for the use of Gimel
2.1 In order to use the Services* provided by Gimel, you must have a Gimel Account. Please register with Gimel and provide the requested information. Some Gimel Services* may require additional information to be fully utilized. For example, to use the Payment* services, your account information and identity verification are required. Users are requested to ensure that all data provided during the registration process or subsequently in their Gimel Account are accurate and belong exclusively to them. This also applies to the identification of a legal representative. It is not allowed to store information about bank accounts, e-mail addresses, mobile phone numbers or any other data shared with third parties. It is the user’s responsibility to ensure that this information is kept up to date. In case of misuse or illegal use of the Gimel Services* or the Gimel Platform, Gimel reserves the right to block the Gimel Account, restrict the use of the Gimel Services* and, if the relevant conditions are met, to terminate the Contract of Use without notice and delete the Gimel Account.
2.2 Please note that the use of our Services* is permitted only after the subscription has been confirmed. For your security, Gimel will provide you with a PIN (Personal Identification Number, which is used, for example, to validate electronic transactions) and a PUK (Personal Unblocking Key, which is used, for example, to manage your 2-factor authentication at Gimel) and other personalized security features for use with certain features. It is not permitted to share access information or personalised security features associated with your Gimel Account. Access information and personalised security features must be stored securely and protected from access by third parties. They may not be disclosed to third parties. In case of suspicion of unauthorized use of access information or personalized security features or disclosure to third parties, Gimel must be informed immediately using the contact details provided in the
- 2.3 With the confirmation of your Gimel Account, your user agreement with Gimel becomes effective in accordance with this Terms of Use. Gimel reserves the right to refuse to enter into a user agreement at its sole discretion. Please note that no user agreement will be concluded between you and Gimel if you do not provide all the information required for the creation of a Gimel Account during the registration process. In such a case, Gimel will proceed to delete the data already collected.
2.4 In case of security concerns, in case of loss or compromise of access information or personalised security features, Gimel reserves the right to deny access to certain data and remove it from your Gimel Account.
- Services*
3.1 As a user, you can keep your data in your personal Gimel Account. After activating your Gimel Account, Gimel will provide you with Services* that you can use at Gimel or at Gimel Partners. Gimel Partners themselves decide which Services* and functions they integrate into their offers. It is possible that not all Services* can be used with a Gimel Partner everywhere. Gimel currently offers or plans to offer the following functionalities (with some of them under development):
3.1.1 Authentication (Gimel Access): This enables you to send your data to Gimel Partners or to log in to Gimel Partners using the Gimel button with the access data for your Gimel Account. This allows you to use your Gimel Account as a single login, to consolidate the subscription processes with Gimel Partners as much as other relying parties or to import available data to complete your Gimel Account. With Gimel Access you can also use your Gimel Account with the corresponding app as MFA feature (Multi Factor Authentication) to authenticate yourself towards Gimel Partners or other relying parties.
3.1.2 Identification (Gimel ID): At Gimel, you can store your verified and updated identity (especially your identification data) according to the standards set by Gimel Foundation in your Gimel Account and transmit it to Gimel Partners. In this way, you can fulfil your identification obligation to the Gimel Partner without having to go through a new identification procedure.
Please note that there are different levels of trust in the identification process. The upgraded Gimel ID based on genetic data is the most secure solution. Alternative and/or additional identification procedures can be used. In some cases, it may be necessary to update or complete your verified identity. The data collected to update or complete your verified identity will be stored in your Gimel Account. If you go through a new identification procedure, e.g. to update your verified or upgraded identity, the data stored in your Gimel Account until then may be overwritten. The overwritten data will no longer be available in your Gimel Account.
3.1.3 Authorization: Based on the Gimel ID, we can facilitate the authorization of AI systems and digital agents. Based on web3 appliances*, we can help to provide transparency as to the power of attorney, which such systems and agents do have, or which decisions they are supposed to take. This kind of transparency can enable a “four eye principles” between an AI system or agents and the relying party, thus helps AI systems or agents to legitimate.
3.1.4 Age Verification: Based on your personal data and the verification of your identity, Gimel can share information to confirm your age, using the Gimel button with the access data for your Gimel-Account.
3.1.5 Digital Signature: Gimel allows you to digitally sign documents in PDF format on the Gimel platform or at Gimel Partners with a qualified electronic signature (QES). In principle, you can even meet the written form requirement.
3.1.6 Payment function*: With Gimel you will have the possibility to make payments to a Gimel Partner via the Gimel Wallet, prospectively. For details, we will refer to our “Additional conditions for Payments” once the Digital Signature* service is established.
3.2. You can monitor and individually manage used Services* and transactions in your Gimel Account. In connection with an Authentication the Gimel Partner may send authentication texts to Gimel to be authenticated, which are then displayed to you in the app and may later also be monitored and managed by you.
- Availability
Gimel shall endeavor to keep the Services* of the Gimel ID, the Gimel Wallet*, Bespoke G-Wallet and the Gimel Platform available at all times outside of necessary maintenance windows. Gimel is entitled to temporarily or permanently prevent or restrict your use of the Gimel Services* or the Gimel Platform if and to the extent required for the security of the Gimel Platform and/or the systems used for its operation or the data stored thereon, or by a legitimate interest of Gimel.
- Information for the usage of trust services
Gimel is an identity service and wallet provider offering online Services* to identify natural persons. This also includes identification services prior to the usage of a qualified trust service in accordance with the eIDAS 2.0 regulation.
- Amendments to these terms of use or agreed additional terms
Gimel shall notify you of changes to these Terms of Use or agreed additional terms and conditions in writing, highlighting the changes, at least two months before the planned effective date. If you do not object to the changes within this period, you shall be deemed to have agreed to the changed terms of use or additional conditions. Gimel will again draw your attention to this consequence when informing you of the amended Terms of Use and/or additional conditions.
- Liability
7.1 The software of the Gimel Platform and its Services* is in the beta phase, which means it is still in the testing and development stage and may contain errors, bugs, or other defects. The user acknowledges that the use of the beta software is at their own risk.
7.2 Gimel assumes no liability for direct, indirect, incidental, or consequential damages resulting from the use of the beta software. This includes, without limitation, damages for loss of data, loss of business profits, business interruption, or other economic losses, even if Gimel has been advised of the possibility of such damages.
7.3 The beta software is provided “as is,” without any express or implied warranties. This includes, but is not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.4 The user is responsible for backing up their data and taking appropriate security precautions. While Gimel strives to implement the highest standards of data protection, users are advised to take their own precautions to ensure their data security during the beta testing phase. Gimel assumes no responsibility for the loss or damage of data in connection with the use of the beta software.
7.5 Participation in the beta test is voluntary, and the user may discontinue use of the beta software at any time. By participating in the beta test, the user agrees to the terms of this disclaimer.
- 6 Gimel reserves the right to modify, update, or discontinue the beta software at any time. The user will be informed of significant changes.
7.7 Irrespective of the legal basis, where liability is based on fault, Gimel’s liability for damages caused by intentional acts and gross negligence shall be unlimited. In the event of simple negligence Gimel shall be liable only for losses arising out of injury to body, life or health.
- Termination
8.1 You may terminate the contract of use at any time without observing a notice period and without stating reasons by giving Gimel notice in text form. You can also terminate the user contract by deleting your Gimel Account with us. If you delete your Gimel Account, the user agreement between you and Gimel ends automatically. You are aware that Gimel stores your data for the fulfilment of legal obligations to keep records even after your Gimel-Account has been deleted. This applies to the obligation to retain your data for at least 10 years for the purpose of identification for the creation of a qualified electronic signature.
8.2 Gimel has the right to terminate the contract at any time with two months’ notice to the end of a calendar month.
8.3 The right of extraordinary termination remains unaffected for both parties.
8.4 In the event of termination of the user agreement, Gimel will delete your Gimel Account at the end of the user agreement. From this time on, the use of the Services* of Gimel and the Gimel Platform is no longer possible. As far as data must be kept for complying with any legal storage or retention periods, they will be stored until the expiry of these periods. If data are still required for the processing of outstanding transactions, these data will be deleted at the earliest after the processing of these transactions.
- Other
9.1 German law shall apply, excluding conflict of law’s provisions. This shall not affect the applicability of mandatory consumer protection provisions.
9.2 Should a provision of these terms of use prove to be invalid, unlawful or unenforceable, the validity, legality and enforceability of the other provisions of these terms of use shall not be affected.

Gimel Technologies GmbH is neither prepared nor obliged to participate in dispute resolution proceedings before a consumer arbitration body in accordance with the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz).
